Mombasa Governor Hassan Joho’s first wife Madina Giovanni Fazzini has filed for a divorce before Mombasa Chief Kadhis Court after nine years of separation.

In her sworn affidavit, the two are still a couple under Islamic law but she wants it ended legally.

“At all material times relevant to this suit, the petitioner (Fazzini) and respondent (Joho) were and are still husband and wife having married under Islamic law on February 11 2011,” her affidavit in a case she filed on January 26, 2022, reads in part.

She also attached a marriage certificate and birth certificates of the two children she bore with Joho. The children are currently aged nine and eight years respectively.

She says the marriage has completely broken down and cannot be revived.

“I am clear and unequivocal that our marriage has broken down irretrievably with no chance of revival given we have both moved on over the years,” Fazzini said in her affidavit filed in court.

She says that Joho moved out of their matrimonial home in 2013 leaving her with the two children behind.

“Since the respondent, Joho, moved out of our matrimonial home in June 2013, the substance of our marriage has dissipated and has no basis to be sustained from a legal and social standpoint,” Fazzini said.

She explained that they lived with Joho as husband and wife from the onset of their marriage until January 2013 when they technically separated adding that she lived in the matrimonial home until September 2020 before starting to live on her own.

“I lived in the matrimonial home until 2020. Since then I have been living on my own,” Fazzini explained.

She now prays that the marriage between them be dissolved and any other or further relief the court may deem fit to grant in the circumstances.

Joho has been accorded 14 days to respond to the petition but is yet to reply to it.
