The former sports CS had been charged alongside National Olympic Committee Kenya official Soi, former Sports PS Richard Ekai, Haron Komen, former director of administration at the Ministry of Sports, Francis Kinyili and Patrick Kimathi Nkabu.

But Ekai, Komen, Kinyili and Nkabu were acquitted on grounds of insufficient evidence.

The court heard that Wario approved the inclusion of three other persons travel to Rio and subsequently paid them allowances with Magistrate Juma saying this amounted to abuse of office.
